송기헌 의원 “‘미성년자 빚 대물림 방지’ 입법방안 모색 토론회”

더불어민주당 송기헌 국회의원은 서울사회복지공익법센터(이하 ‘공익법센터’)·최기상 의원과 함께 30일 오후 2시‘미성년자 빚 대물림 방지를 위한 민법 개정의 필요성과 개정방향’을 주제로 토론회를 개최했다.

현행법상 미성년자는 스스로 상속여부를 결정할 수 없다. 이로 인해 법정대리인의 법률 무지나 대리권 불행사 등으로 미성년 상속자가 본인 의사와 관계없이 부모의 채무를 승계하는 일이 발생해왔다. 이에 현행 상속제도에 존재하는 미성년 상속인 ‘보호 사각지대’를 입법을 통해 해소하려는 움직임이 진행되어왔다.

 

이번 토론회는 지난 5월 송기헌 의원이 대표발의한 관련 민법 개정안 등이 국회에서 본격적으로 논의되기 전, 법 개정의 필요성을 알리고 개정안의 분석을 통해 보완점을 찾기 위해 마련됐다.

발제에 나선 전가영 변호사는 “현행법상 미성년자는 스스로 법률행위를 하지 못해 한정승인, 포기 절차 또한 반드시 법정대리인을 통해서만 가능하다”며, “그렇기에 법정대리인의 역할이 매우 중요한데, 저소득 한 부모 가정, 가정위탁, 보호시설 거주 아동 등은 법정대리인과 연락이 단절되어 있는 경우가 많아 빚이 대물림될 위험이 크다”고 말했다. 이어 “현행 제도는 취약계층일수록 피해를 받게되는 가혹한 구조”라며 현행 상속제도의 문제점을 지적한 뒤 조속한 법 개정을 촉구했다.

 

성유진 변호사는 현재 국회에 제출된 4개 개정안을 미성년 상속인에 한하여 한정승인이 의제되는 일률적 규정을 마련한 송기헌·백혜련·이병훈 의원안,‘미성년 상속인이 성년이 된 이후 본인의 인식을 기준으로 하는 별도의 고려기간을 부여’하는 최기상 의원안으로 분류한 뒤 각각을 분석했다. 또한 성 변호사는 실무상 겪었던 문제들에 비추어 미성년 상속인이 특별대리인을 선임하여 사후신고를 할 수 있게 하는 규정, 세금 부과와 관련된 특칙의 마련 등 개정안의 보완책을 제안했다.

 

이어진 토론자 발표에서 이하정 법원행정처 사무관은 “미성년 상속자 보호를 위한 입법적인 해결방법을 검토함에 있어서 현행제도와의 정합성이나 법적 안정성, 채권자 등 이해관계인들에게 미치는 영향 등을 충분히 고려해야한다”며, “한정승인에 필요한 재산목록의 제출, 채권자에 대한 공고절차, 청산절차에 대해 별도의 규정을 두어야 할 필요가 없는지 추가적인 검토가 필요하다”는 의견을 밝혔다.

 

김성호 국회입법조사처 조사관은 “미성년 상속인 보호와 관련된 다양한 접근방식을 종합적으로 검토해볼 필요가 있다”며 상속여부의 고려 기간을 현행 3개월에서 확대하는 방안, 프랑스법의 영향을 많이 받은 우리 상속법의 체계를 장기적으로 영미법과 같이 변경하는 방안 등을 제시했다. 

 

 최성경 단국대 법대 교수는 “판례에 따르면 성년 상속인과 적절한 대리권 행사가 가능한 법정대리인을 둔 미성년 상속인은 채무를 피할 수 있고, 법정대리인이 잘못된 대리권 행사를 한 미성년 상속인만 상속을 피할 길이 없다”며, “채권채무관계에 대한 정보도, 자기 결정권도 없었던 미성년 상속인이 수년이 흐른 뒤 스스로 성취한 경제활동의 결과물에 강제집행을 당하게 되는 것은 법적 안정성이라 칭해질 수 없다”고 지적했다.
