기독교복음선교회 교인협의회측은 10월1일자 보도자료에서 “기독교복음선교회(세칭 JMS) 정명석 목사의 공정 재판을 촉구하는 선교회 교인들의 1인 시위가 추석 연휴에도 이어지고 있다. JMS 정명석 목사의 법관 기피신청으로 약 2개월간 재판이 중지된 상태임에도 정명석 목사의 공범으로 재판에 넘겨진 김씨를 비롯한 여성간부 6명의 재판이 속전속결로 진행됐다. 지난 9월26일 대전지법 제12형사부 심리로 열린 결심 공판에서 선교회 내 ‘2인자’로 불리는 김씨 포함 여성 간부 6인에 대한 검찰의 구형에 이어 지난 9월27일 정명석 목사 재판의 기피신청 항소심까지 기각되자, 선교회 교인들이 강력하게 반발하는 상황”이라면서 “기독교복음선교회 교인협의회는 지난 9월27일 입장문을 내고, 그간 수사과정 중 드러난 의혹과 검찰이 정명석 목사의 방어권을 침해하며 증거 없이 진술만으로 여성 간부 6명에게 구형을 한 것에 이의를 제기했다”고 전했다.
기독교복음선교회 교인협의회측은 입장문에서 “정명석 목사 재판은 사실 피해자라는 고소인의 일방적인 주장만 있을 뿐 증거가 없다고, DNA도 검출되지 않았고 고소인 A양이 당시 성 피해 상황을 담았다고 언론사에 제출한 녹취파일도 조작·편집된 사실이 드러났다“고 밝혔다.
이어 “고소인 A양의 일기장에는 ‘매일 매 시간 껴안고 입 맞추고 사는 것 아니라서 선생님(정명석 목사 지칭) 나오시고 그전에 상상했던 거 하나도 이뤄지지 않아서 실망했다’라는 내용이 기록되어 있다. 이는 정명석 목사와 고소인 사이에 아무런 일이 없었다는 것을 방증하는 것”이라면서 “이와 별개로 수사관 B경위는 지난 4월 3일 A양 증인 신문 시, 실수로 아이클라우드의 녹취파일 사본을 삭제했다고 증언 했다. 이후 지난 5월16일 9차 공판 때 정명석 목사 변호인단이 ‘아이클라우드에서 파일을 삭제하려면 3번의 클릭이 필요하고 휴지통에서도 1개월내 복구 가능해 고의 삭제가 의심된다’고 지적하자 B 경위는 ‘아이클라우드에 녹취파일이 없었음에도 있다고 착각해 ‘직접 피해자와 함께 클라우드로 접속해 피해자 계정 아이클라우드에 실제 해당 녹취파일이 있음을 확인했다’고 압수조서에 잘못 기재했다’고 자백까지 한 상황”이라고 주장했다.
기독교복음선교회 교인협의회측은 이 자료에서 “▲아이클라우드에서 녹취 파일 사본을 다운받는 과정에서 포렌식 전문가가 아닌 수사관 B경위가 A양을 직접 만났다는 점, ▲녹취파일 사본을 수사관 B경위가 직접 다운로드 받은 것이 아니라 A양이 다운받아 전송해준 사실, ▲2장의 증거 CD 각각의 녹취파일명을 바꾼 점 등 증거 압수 절차상 다수의 문제점이 발견되어 A양이 제출한 녹음파일은 인위적 개작 가능성이 강력하게 의심되는 상황이다. 이 외에 ▲수사관이 핵심 증거를 실수로 삭제했다면 검찰측에서 그 책임을 엄하게 물어야 하나 그렇지 않았던 점, ▲포렌식 정밀 분석을 위한 증거 CD 등사 요청이 불허된 것도 피고인의 방어권을 침해한다”는 주장을 폈다.
기독교복음선교회 교인협의회측의 이 같은 주장에 따라, 고의 증거 인멸, 허위 공문서 작성 등 경찰의 조작 수사 의혹이 불거졌다. 서울강북지역회 새벽별 장로단은 지난 9월31일 충남경찰청 소속 담당 수사관인 B경위와 C경장을 국가수사본부에 고발해 수사가 이루어지고 있다.
교인협의회 대표 곽동원 목사는 “현 재판부가 방조 혐의를 받고 있는 여성목사들의 재판 결과를 통해 정명석 목사 재판에 악(惡) 영향을 주려고 한다는 의심을 떨칠 수가 없다”면서 “그들이 유죄가 되면 정명석 목사 또한 유죄를 구형하는 수순을 밟으려고 하는 것이 불을 보듯 뻔하다”고 강조했다.
지난 9월26일 뉴시스 등 언론 보도에 따르면, 결심 절차에 앞서 피고인 신문에서 김 아무개는 “직접 목격하지는 않았으나 신도들이 성범죄 사실을 토로했으며 이를 거짓말이라고 믿지 않는다”고 주장했다. 교인들은 “김 아무개가 구속되기 전까지도 선교회에서 중책을 맡고 있었으며 어떤 이유로든 법정에서 사실과는 다른 거짓 진술을 하고 있다”고 항변했다. 뭔가 잘 짜여진 스토리에 의해 움직이고 있다는 인상을 지울 수 없다는 것.

기독교복음선교회 교인협의회측은 “김 아무개는 법정에서 분명히 성범죄를 직접 목격하지는 않았다”고 피력하고 “그럼에도 검찰은 증거가 없이 이러한 진술만을 바탕으로 구형을 했다. 변호인들이 검사가 객관의무(객관적 제3자의 입장에서 직무를 수행해야 한다는 원칙)를 다하지 않았으며 범죄가 증명되지 못했고, 합리적 의심의 여지가 온 법정에 차고도 남는다면서 무죄를 선고해 줄 것을 주장했으나 받아들여지지 않았다”고 호소했다.
정명석 목사는 넷플릭스 ‘나는 신이다’ 방영 이후 마녀사냥식 여론몰이식 언론보도로 인한 여론 재판을 먼저 받았고 증거물 오염, 조작 수사 의혹, 고의 증거 인멸, 재판절차 공정성 등이 도마에 오르면서 재판이 논란이 되고 있다. 이와 관련, 교인협의회 대표인 곽동원 목사는 “현 재판부는 기독교복음선교회를 조직적으로 범죄를 저지르는 집단으로 폄훼하고 있다. 그렇지 않고서야 이런 식의 졸속 재판을 진행할 수 없으며 상식에 벗어난 중형을 구형할 수 없다”고 피력했다. 이어 “교인협의회는 이에 대해 강력하게 규탄하며 모든 방법을 강구해 정명석 목사의 무죄를 밝혀나갈 것임을 천명한다”면서 “다시 한 번 현 재판부가 여성 간부들에 대한 선고를 증거 제일주의 원칙에 따라 멈추고 절차에 따른 공정한 재판을 진행해 주기”를 촉구했다.

In a statement, the Christian Gospel Mission Church member council said, “Pastor Myung-Seok Jeong’s trial is in fact only a one-sided claim by the accuser that he was a victim, and there is no evidence. No DNA was detected, and a recording submitted to the press by accuser A that contained the sexual victimization at the time. “It was revealed that the file was also manipulated and edited,” he said.

Following these claims from the Christian Gospel Mission Church members' council, suspicions arose of police manipulation of the investigation, including intentional destruction of evidence and creation of false official documents. On September 31, the Morning Star Elders of the Seoul Gangbuk Regional Association reported Inspector B and Inspector C, the investigators in charge of the Chungnam Police Agency, to the National Investigation Headquarters, and an investigation is underway.
Pastor Kwak Dong-won, representative of the church members’ council, said, “I cannot shake the suspicion that the current court is trying to negatively influence the trial of Pastor Jung Myung-seok through the trial results of female pastors accused of aiding and abetting. If they are found guilty, Pastor Jung Myung-seok will also be guilty.” He emphasized, “It is as obvious as seeing fire that they are trying to take steps to seek .”
According to media reports such as Newsis on September 26, in the defendant's newspaper prior to the decision process, Mr. Kim claimed, "I did not witness it directly, but believers have told me about sexual crimes, and I do not believe that this is a lie." The church members protested, saying, “Mr. Kim was holding a key position in the missionary church before he was arrested, and for some reason, he is making false statements that are different from the facts in court.” One cannot shake off the impression that something is being driven by a well-crafted story.
The Christian Gospel Mission Church member council stated, “Mr. Kim clearly did not directly witness the sexual crime in court,” and added, “Nevertheless, the prosecution sought sentencing based only on these statements without any evidence. The defense lawyers argued for a not guilty verdict, saying that the prosecutor did not fulfill his duty of objectivity (the principle of performing his duties from an objective third party's perspective), that the crime was not proven, and that the court was left beyond a reasonable doubt. “It was not accepted,” he complained.
