방역패스 백화점·마트 등 일부만 효력 정지..공익성 인정

법원, 서울시내 국한해 상점 마트 등 효력 정지..청소년에 확대 적용도 중지

브레이크뉴스 노보림 기자= 법원이 방역패스 실행을 중지해달라는 소송에서 일부 시설에 대한 효력을 중지했다.

 

12일 법원에 따르면 서울행정법원 행정4부(부장판사 한원교)는 이날 조두형 영남대 의대 교수 등 1023명이 보건복지부장관·질병관리청장·서울시장을 상대로 낸 방역패스 효력 집행정지 신청에 대해 일부 인용했다.

 

재판부는 질병관리청장과 보건복지부 장관에 대한 청구는 각하했고, 서울시에 대한 신청을 일부 인용했다. 

 

이에 따라 서울 지역에 국한해서만 상점·마트·백화점에 적용되던 방역패스의 효력과 12~18세 청소년에 대한 방역패스 확대가 중지된다. 

 

이는 사실상 방역패스 전반에 대한 집행정지는 대부분 기각된 것으로, 식당·카페·실내체육시설·영화관 등에 적용되던 방역패스 효력은 전국에서 동일하게 유지된다. 

 

조두형 교수 등은 백신의 접종 여부는 개인의 선택에 달린 문제라며 방역패스를 통해 사실상 백신 접종을 강제하는 것은 신체 결정권을 침해한다고 주장하며 방역패스 대상 시설 17종 중 유흥시설을 제외한 10종에 대해 집행정치를 신청했다.

 

하지만 법원은 비교적 감염 위험도가 낮다고 평가받는 마트·백화점 등에 대한 방역패스 효력만 정지하면서 사실상 이번 패소에 가깝다는 평가가 나온다.

 

마트·백화점 등에 방역패스 효력을 정지한 이유로는 이들 시설이 '1차적 생활시설'이라는 점과 식당·카페 등과 비교해 비교적 감염 위험도가 낮다는 점을 들었다. 또한 이들 시설에 굳이 방역패스를 적용하지 않더라도 마스크 쓰기, 사회적 거리두기 등의 조치만으로도 위험도를 낮출 수 있다면서 최소침해 원칙을 위반한 것으로 봤다. 

 

청소년 방역패스 효력 정지도 위와 같은 논리로 효력을 정지했다. 청소년의 경우 중증화율이 현저히 낮고, 사망 사례도 적다는 통계가 그 근거로 인용됐다. 하지만 이 두 결정 모두 서울 시내에서만 적용된다.

 

결국 법원은 코로나19 확산을 막고 중증환자·사망자 감소를 위해 정부가 방역패스를 시행하는 자체에 대해선 과도한 기본권 제한은 아니라고 본 셈이다.

 

복지부는 법원 심문과정에서 방역패스 공익성에 대해 '백신 미접종자인 코로나19 확진자의 중증화율과 치명률을 낮춰 의료대응 여력을 확보하고 감염 확산을 막기 위한 백신접종률을 제고하는 것이 주된 목적'이라고 밝혔다. 

 

또한 "미접종자는 6%에 불과하지만, 지난 8주간 확진자 20만명 중 30%가 미접종자이며 중환자도 52~53%에 달했다. 백신은 미접종자의 중증·사망을 방지한다"는 주장을 펼쳤는데, 재판부가 이를 상당부분 인정한 것으로 보인다.
