Controversy Over the Nomination of Two Supreme Court Justices, Son Bong-gi and Kim Seong-su... Who Bears the Greatest Responsibility?
- Journalist Kim Se-hyung
The Blue House and the ruling party are in an uproar, acting as if their very survival depends on ousting Chief Justice Cho Hee-dae, who signed and nominated two judges, Son Bong-gi and Kim Seong-su, on August 18 to succeed Justices Roh Tae-ak and Lee Hong-ku. The procedure for appointing new Supreme Court justices is set up so that the Chief Justice nominates candidates to the Presidential Office; if approved, the nominees are sent to the National Assembly for a hearing, after which the President makes the final appointment (Article 104 of the Constitution).
The President and the National Assembly, elected by the people, hold the dominant position, while the Chief Justice is in a defensive position, required to recommend a new candidate if their previous nomination is rejected. This is a scene where the separation of powers—where the President and the National Assembly, elected by the people, possess legitimacy, while the unelected judiciary gains legitimacy through verification by the executive and legislative branches—intersects. Just as the Korean Constitution is described as an imperial presidency, the President’s power is indeed immense in the appointment of Supreme Court Justices. In the case of the recent nominations of Son Bong-gi and Kim Seong-su, it appears that the Minister-level Chief of the Court Administration Office pleaded with the Blue House Senior Secretary for Civil Affairs regarding the candidates selected by the Supreme Court’s Justice Recommendation Committee. Chief Noh Geon-pyeong explained this when summoned to the National Assembly’s Legislation and Judiciary Committee. His explanation was that the Chief Justice had requested to meet with the President to explain the situation, but the request was denied. This could be interpreted as the President not wanting to see the Chief Justice.
As is well known, there is a significant divide between President Lee Jae-myung and Supreme Court Chief Justice Cho Hee-dae. First, Cho Hee-dae was appointed during the Yoon Suk-yeol administration and is not President Lee Jae-myung’s right-hand man. The decisive event occurred just one month before the presidential election when the Supreme Court overturned a High Court ruling on election law violations against candidate Lee Jae-myung, sending the case back for retrial with a view to guilt, nearly invalidating his presidential candidacy itself. The Blue House and the ruling party view Chief Justice Cho Hee-dae as having spearheaded that ruling. Therefore, rumors of Cho Hee-dae's impeachment have been widespread since the launch of the new government, and last March, 112 lawmakers from the ruling coalition submitted written consent for his impeachment. It is said that while the two candidates were being coordinated, the Blue House approved Kim Sung-soo, and President Lee Jae-myung wanted Judge Kim Min-ki; however, the Supreme Court refused to grant this request and abruptly issued a signature nomination including Son Bong-ki.
The Supreme Court argues that since the President has already appointed Judge Oh Joon-young as a Constitutional Court Justice, appointing his spouse, Judge Kim Min-ki (female), would be inappropriate as it would mean a married couple would hold concurrent positions as Supreme Court and Constitutional Court Justices. When asked about this, Sung Nak-in, a prominent constitutional scholar and former President of Seoul National University, asserted, "It is unthinkable for a married couple to be appointed as Supreme Court and Constitutional Court Justices." Former Prime Minister Kim Hwang-shik, Professor Cha Jin-ah, and Yulchon Chairman Woo Chang-rok also shared the opinion that "it makes no sense."
Let us review once again the situation in which Chief Justice Cho Hee-dae was driven into a written nomination. During the recent party leadership election, both Kim Min-seok and Jeong Cheong-rae shouted that "Cho Hee-dae is grounds for impeachment," pointing out that the position of successor to candidate Roh Tae-ak had been left vacant for over five months. Rumors were widespread that whoever won would oust Cho Hee-dae. The Supreme Court found itself pressed for time. Judge Kim Seong-su was tentatively selected as the successor to Supreme Court Justice Lee Hong-ku.
However, last January, four judges—Kim Min-ki, Park Soon-young, Son Bong-ki, and Yoon Seong-sik—were selected as successors to Roh Tae-ak; however, Kim Min-ki was not accepted due to the aforementioned circumstances, and Park Soon-young and Yoon Seong-sik also became unavailable due to other unforeseen circumstances. The explanation was that unless a new candidate recommendation committee was formed, there was no alternative other than Son Bong-ki, and given the tight schedule, a written nomination was unavoidable.
In fact, according to Article 104 of the Constitution, the Chief Justice of the Supreme Court is only required to make a nomination, regardless of whether the successor is selected in writing or through prior coordination, in accordance with the separation of powers. Whether or not to accept the nomination proposal is the President's prerogative; if the proposal is not accepted, the Supreme Court must search for a new candidate and make a nomination. If the process is not smooth, both sides face a heavy political burden. If the Blue House continues to veto judges nominated by the Chief Justice, the Chief Justice’s reputation is severely damaged; conversely, if the Supreme Court keeps nominating figures the President dislikes, forcing the President to reject them one after another, it places a heavy burden on the President as well. Therefore, to reduce mutual burdens, the Blue House Office of Civil Affairs and the Court Administration have coordinated and decided in advance, and the President and the Chief Justice have met merely to take photos. Many legal scholars suggest that it would be better to switch to the custom of written requests to remove the element of "politics" from the process.
When meeting Chief Justice Cho Hee-dae, he gives the impression of a scholar with a fine physique, lacking the guts of a typical politician. He is a typical figure of outward gentleness and inner strength—a delicate individual. He is evaluated as someone who lacks the cunning to mobilize such tactics to put the President or the National Assembly in a difficult position.
President Lee Jae-myung's Democratic Party amended the three judicial laws to increase the number of Supreme Court Justices from 14 to 26, and the plan is to appoint 22 Justices during the term. Even if he faces trial after his term ends, he will secure a highly favorable position. The Blue House and the ruling party would not have gotten angry just to win over Son Bong-gi, who effectively vetoed the nomination this time. The President could have easily coordinated the matter, perhaps by having dinner with Chief Justice Cho Hee-dae. Kim Min-seok, who has just become the party leader, could not have been unaware that Chief Justice Cho Hee-dae was cornered because the Presidential Office refused to set a date. Nevertheless, his directive to hang banners nationwide reading "Cho Hee-dae, destroyer of the rule of law, step down" (at a cost of hundreds of billions of won) will likely have an impact on his dignity as a leading contender for the next presidency. The prominent legal experts mentioned above pointed out that Party Leader Kim Min-seok should have naturally played a mediating role when the President and the Chief Justice clashed.
What else lies behind the scenes that is causing the Party and the Blue House to join hands to complicate such a seemingly simple matter? Come to think of it, it seems likely that they needed an enemy of an enemy to block any dissenting voices from Rep. Jeong Cheong-rae's camp following his defeat in the party leadership election, and given the need for unity within the ruling camp due to the President's falling approval ratings. News of all Democratic Party lawmakers gathering at the Blue House is also making headlines. Was it really just that? But surely the shrewd public wouldn't notice that? If Cho Hee-dae is truly a candidate for impeachment, wouldn't his approval ratings skyrocket if they boldly pushed ahead and succeeded?
