The Invisible Direction of the Democratic Party's Governance... What Cards Can the Opposition Play?

- Former National Assembly Member Lee Jung-hyun

If we connect the political events currently taking place publicly into a single flow, a remarkable puzzle falls into place. From the pressure for Chief Justice Cho Hee-dae's resignation, the crime of distorting the law, the judicial appeals system, and the increase in the number of Supreme Court Justices, to the separation of investigation and indictment by the prosecution, the establishment of a court dedicated to insurrection, the restructuring of public broadcasting governance, the regulation of false and fabricated information, the argument for dissolving the People Power Party as an unconstitutional party, and the call for a constitutional amendment for a four-year presidential term with the possibility of consecutive terms—these may appear to be separate incidents, but their direction seems quite consistent. The Democratic Party has already passed the so-called "Three Judicial Reform Bills," which include the crime of distorting the law, the judicial appeals system, and the increase in the number of Supreme Court Justices. They also passed a bill to increase the number of Supreme Court Justices from 14 to 26. Chief Justice Cho Hee-dae publicly warned that this fundamentally alters the framework of the 80-year-old judicial system and constitutes a grave matter that could amount to a constitutional amendment.

The Democratic Party's Invisible Direction of Governing the State... What Cards Can the Opposition Play? This extends to prosecution reform that involves dismantling the Prosecutor's Office and transitioning to a system of the Indictment Agency and the Serious Crimes Investigation Agency; media reform that changes the rules of public broadcasting and internet public opinion; and even calls for a court dedicated to insurrection cases and the dissolution of the People Power Party as an unconstitutional party. In fact, the Democratic Party leadership has repeatedly mentioned the possibility of dissolving the People Power Party as an unconstitutional party. Each of these may have its own justification. However, the intentions of the ruling power must be judged not by the justification of individual issues, but by the power structure created when all these issues are combined.

First, it is to confine past administrations and the opposition party within a single framework of insurrection and anti-democratic forces. If they are defined not as competitors in policy competition but as forces to be liquidated, compromise and cooperative governance become unnecessary. The opposition party's arguments are branded as advocating insurrection before they are evaluated on their substance.

Second, it is to weaken the independent checks and balances of the judiciary and investigative agencies. The fate of Cho Hee-dae as an individual is not the essence of the matter. The real issue is the suspicion that the administration is attempting to tame the judiciary—which is capable of issuing rulings unfavorable to the regime—through political pressure and institutional reform.

Third, it involves changing the rules of broadcasting and online public opinion. Reforming public broadcasting and preventing false information are necessary. However, determining what is false and who will make that judgment is more important. If the government and the majority party effectively seize control of the power of judgment, the regulation of fake news could turn into a means to silence critical media and the public.

Fourth, it involves utilizing hardline supporters as a political executive outside the official organization. Hardline supporters, often referred to as "X-ddals," suppress internal party dissent and attack opponents through text message bombs, targeting specific locations, collective petitions, and online public opinion campaigns. Even without direct evidence of direct orders from the administration, if their influence is condoned or politically utilized, they function as a de facto unofficial power.

Fifth, it involves dividing the conservative opposition party. Sixth, there is a possibility that a constitutional amendment awaits at the end. The four-year consecutive term system itself is certainly open to discussion. However, the situation changes if the structure of the judiciary, investigation, media, and opposition is reorganized first, followed by the push for a constitutional amendment directly linked to extending power. This is because a constitutional amendment could serve not as a national reconstruction for the people, but as a blueprint for the ruling power's long-term hold on power. Ultimately, the final goal may go beyond merely extending the term of a single president. It involves weakening the checks and balances of investigative agencies and the judiciary, securing dominance over broadcast and online public opinion, isolating the opposition as an anti-constitutional force, and then creating a political structure that enables long-term rule through constitutional amendment.

This is the most serious suspicion raised when connecting the various current movements.

How should the People Power Party respond? The cards available to the opposition are clear. First, the card of the Constitution. Second, the card of records and transparency. Third, the card of a national referendum. Fourth, the card of a divided response. Fifth, the card of solidarity. Sixth, the card of alternatives. Seventh, the card of new figures. Eighth, the card of politics in which party members and the public participate directly. Ninth, the cards of the moderates and the Honam region. What the opposition party must protect now is a country where the judiciary does not bow to the whims of power, where the media does not fear the government, where the opposition party does not exist by relying on the regime's permission, and where the people can speak freely.

We must place the publicly disclosed bills and appointments, investigations and trials, media policy and movements for constitutional amendment onto a single map and ask the people: Are we trying to protect specific individuals and the vested interests of the past, or are we trying to protect the Constitution and the freedom of the people?
