이번 6ㆍ3지방선거에서 낙선한 국민의힘 최민호 세종시장이 18일 선거 무효를 주장하고 나섰다.
최 시장은 이날 오후 시청 정음실에서 긴급 기자 회견을 열고 개표상황 당시 투표지 개표시각과 공표시각이 불일치하는 중대한 제보가 있어 전날(17일) 중앙선거관리위원회에 선거효력 무효소청을 제기했다"고 밝혔다.
그는 "개표상황표는 선거 결과를 국민과 언론에 공식적으로 공표하는 핵심 문서"라며 " 개표시각이 2026년 5월12일이라는 날짜와 시간이 인쇄돼 있고 이런 문서에 실제 개표 결과(2026년 6월 3일)가 기재돼 있다면 시민들이 납득하기 어려운 부분"이라고 주장했다.
이어 " 개표일과 무관한 날짜와 시각이 개표시각으로 인쇄되어 있는지 해당 문서가 어떤 경위로 작성 사용되었는지 선관위의 정확한 설명이 필요하다"고 했다.

최 시장은 "이 같은 표기가 1 곳이 아닌 조치원읍 제3투표소, 도담동 제2투표소 소담동 제3투표소 제 2선거구 등 여러 투표구 개표 상황표에서 반복적으로 확인됐다"고 했다.
특히 "선거의 공식 문서에서 동일한 형태의 의문이 반복적으로 확인됐다면 투명하게 검증하는 것이 민주주의 절차에 부합하는 것"이라며 "선거관리위원회 전산기록, 개표관리시스템 로그, 투표지 분류기 운영 기록, 출력 이력 등을 객관적으로 검증하고 투명하게 설명할 필요가 있다"고 했다.
앞서 치뤄진 선거에서 국민의힘 최민호 시장은 민주당 조상호 세종시장 당선인에게 25.2%P 차이로 패배했다.
공직선거법상 선거 무효를 주장하려면 선거일로부터 14일안에 소청을 제기할 수 있고 선관위가 60일 내에 소청을 받아들이면 30일 내에 재선거가 가능하다. 선관위가 기각·각하 결정을 한다면 10일 내에 법원에 선거 소송을 제기할 수 있고, 법원은 소송 제기일로부터 180일 안에 판결을 내려야 한다.
