브레이크뉴스 임국정 기자 = 국민의힘 내 '윤석열 대통령 탄핵 반대' 원외 당협위원장들이 5일 "법원은 불법 구금 중인 윤석열 대통령을 즉각 석방하라"라고 촉구했다.
국민의힘 '탄핵반대 당협위원장 모임'은 이날 서울중앙지법 앞에서 발표한 성명서를 통해 "내란 혐의로 구속 기소된 윤 대통령의 수감은 불법 구금"이라며 이같이 주장했다.
이들은 "내란죄에 대한 수사권도 없는 공수처(고위공직자범죄수사처)가 현직 대통령을 재직 중 형사소추가 불가능한 직권남용 혐의로 수사하고, 나아가 내란 혐의로 수사 범위를 넓힌 것 모두 위법"이라고 지적했다.
이어 "공수처에서 사건을 넘겨받은 검찰이 피의자 구속 만기일이 하루 지난 1월 26일 공소를 제기했다"라며 "공수처가 발부받은 구속 영장 효력이 상실된 상태에서 공소 제기가 이뤄진 만큼, 윤 대통령은 현재 불법 구금 상태"라고 말했다.
탄핵반대 당협위원장들은 또 "이번 사건은 구속 수사와 재판을 필요로 할 만한 '범죄 혐의의 상당성'이 없다"라며 "국헌문란의 목적이나 폭동이 없었던 만큼 내란죄 역시 성립하지 않는다"라고 주장했다. "현직 대통령이 도주나 증거 인멸의 우려가 있다고도 볼 수 없다"라고도 했다.
