브레이크뉴스 임국정 기자 = 더불어민주당이 14일 "윤석열 측 변호인이 하다 하다 이제는 대통령경호처에 특수공무집행방해를 교사하고 나섰다"라며 "엄벌에 처해야 한다"라고 밝혔다.
이건태 민주당 대변인은 이날 서면 브리핑을 통해 "윤갑근 변호사는 어제 경호처 직원을 소집한 자리에서 '여기 계신 여러분들은 전원 특별사법경찰관의 자격이 있기 때문에 (대통령 체포 영장을 집행하는 경찰을) 그 자리에서 체포해도 된다'고 말했다"라며 이같이 전했다.
그는 "법원이 적법하게 발부한 체포 영장을 불법으로 몰면 불법이 되나?"라며 "더욱이 정당한 법 집행을 하는 경찰을 경호관이 체포할 수 있다니 황당무계하다"라고 비판했다.
이 대변인은 "경호처 공무원들은 서울중앙지검 검사장으로부터 특별사법경찰관으로 지명받은 사람들"이라면서도 "이 같은 권한은 대통령 경호 업무 수행 중 인지한 소관에 속하는 범죄에 대해 직무나 수사상 긴급을 요하는 한도 내에서만 행사할 수 있다"라고 지적했다.
이어 "법원이 발부한 체포 영장 집행은 대통령 경호와 무관하다"라며 "경호처 공무원들이 체포 영장을 집행하는 경찰관을 체포하는 것은 법적으로 성립할 수 없다"라고 주장했다.
이 대변인은 "적법한 체포 영장 집행을 방해하도록 지시한 것은 특수공무집행방해 교사에 해당한다"라며 "윤 변호사는 잘못된 교사와 그 교사를 따른 불법 행위에 대해 법적 책임을 져야 할 것"이라고 강조했다.
