윤 대통령 지지자는 제목이 불쾌할지 모르지만, 친위 쿠테타를 한글로 번역한 것뿐이다. 이 난(亂)을 두고 헌법전문가, 국회입법조사처 및 법 전공 지식인들의 견해가 모두 위헌, 위법이 명백하다고 했다.
금일 오전 10시에 대통령은 대국민담화를 통해 ‘사과’를 표명함과 동시에 ‘국정운영을 당과 정부에 일임’하겠다고 한 것에 대한 의문과 건설적인 메시지로서는 부족하다고 판단된다. 대국민담화에 가려진 속내는 ‘여전히 집권하겠다’이다. 그리고 ‘일임’하겠다는 의미는 탄핵 표결을 앞둔 상황에서 국민의힘은 탄핵을 막아달라는 늬앙스가 들어가 보인다. 오히려, 윤 대통령은 사과와 함께 국회의 뜻을 겸허히 받아들이겠다는 담화가 국민의 눈높이에 맞지 않나하는 생각이 든다.
필자는 거시적인 관점에서 난(亂)에 대한 책임은 탄핵이 적절하다고 본다. 그 이유는 먼저, 대의민주주의에서 국민의 뜻을 대변하는 국회의원들의 심판을 우선 받아야 한다. 둘째, 탄핵을 받아야 하는 이유에 대해 역사적 사건을 다시 한 번 더 꼼꼼하게 기록으로 남겨야 한다. 셋째, 절차적 정당성을 강조한 우리 헌법에서 헌법수호를 맡은 헌법재판소의 심판이 있어야 한다. 넷째, 헌법재판소 판결 전까지 그들이 취한 행동에 대해 몸서리치게 국민으로부터 비판을 받고 스스로 반성하고 있어야 한다. 다섯째, 신뢰할 수 있는 수사기관을 통해 철두철미하게 진실을 밝혀야 한다. 여섯째, 국민은 다음 대통령을 선출하기까지 인물, 정치이념, 정당 등 제대로 된 정치적 판단을 할 수 있는 시간이 필요하다. 일곱째, 질서 있는 민주주의 수호는 세계로부터 다시 신뢰를 구축할 수 있는 기회가 된다.
계엄의 최대 피해자는 국민이다. 국내 정치는 차치하더라고 윤 대통령이 권좌에 있는 이상 대외 신인도는 더욱 낮아진다. 외국 정상들이 윤 대통령과 정부를 신뢰할 수 있는지? 윤 대통령이 외국 정상들과 교류를 원활히 펼칠 수 있는지? 윤 대통령이 서명한 국가 간 문서를 국민이 받아들일 수 있는지? 벌써, 자본이탈, 한국에 대한 저평가, 한국 방문에 대한 주의보 등 정치·경제적 부작용이 발생하고 있는 데 대책은 있는지? 등 의문이 든다. 결국, 기업과 국민만 힘 든다.
아쉽지만, 2보 전진을 위해선 잠시 뒤로 물러서서 국가 틀을 재정비한 후, 2보 보다 더 3보 4보 전진하여야 할 것이다.
