국토교통부는 사회 여건 변화에 따른 이용객 감소를 고려해 도시계획시설에 대한 편익시설 설치 규제를 완화하는 ‘도시·군계획시설의 결정·구조 및 설치기준에 관한 규칙’ 일부개정안을 입법예고 한다고 밝혔다.
도시계획시설이란 도시의 기능 유지와 국민의 일상생활을 지원하는 시설로, 도시공간구조나 도시환경에 중대한 영향을 줄 수 있는 기반시설 중 도시관리계획으로 결정하는 시설을 말한다.
그동안 도시계획시설에 편익시설을 설치하는 것을 엄격히 제한했으나, 앞으로는 도시계획시설의 운영·이용 여건, 지역 산업·경제·문화 여건 변화 등을 반영해 필요한 편익시설을 유연하게 설치할 수 있게 된다.
편익시설을 설치할 수 있는 도시계획시설을 23종에서 40종으로 확대한다.
현재는 유원지, 공공청사, 문화시설, 체육시설 등 23종 도시계획시설에만 편익시설 설치가 가능하지만, 앞으로는 광장, 녹지, 공공공지, 공동구, 하천, 유수지 등 건축물이 없는 6종을 제외한 전체 도시계획시설에 편익시설 설치가 가능해진다.
도시계획시설에 설치할 수 있는 편익시설의 종류도 확대한다. 주민 생활과 밀접함에도 도시계획시설에 따라 차등적으로 일부만 설치를 허용하고 있는 1·2종 근린생활시설은 모든 도시계획시설에 전면 허용한다.
아울러 법령상 허용된 편익시설 외에 도시계획시설의 운영여건 개선과 주민 편의 제고를 위해 필요한 편익시설은 도시계획위원회의 심의를 거쳐 설치를 허용한다. 일례롤, 집배송시설, 창고(냉장·냉동 포함), 데이터센터, 500㎡ 이상 운동시설 등은 설치할 수 있다.

국토부 정우진 도시정책관은 “빠르게 변화하고 있는 사회변화를 고려하여 접근성이 우수한 도시계획시설에 대해 국민의 관점에서 과감하게 규제를 완화한 것”이라며 “이번 규제 완화를 통해 도심 버스터미널에 집배송시설·창고를 설치하거나 대학교 내 노유자(노인 및 어린이)시설, 데이터센터를 설치하는 등 시설의 활용도를 제고함으로써 시설 운영여건 개선, 지역주민의 편의 강화, 지역 경제 활성화에 기여할 것으로 기대된다”고 말했다.
