브레이크뉴스 박수영 기자= 내년부터 비트코인으로 소득을 250만원 넘게 벌면 양도차익의 20%를 세금으로 내게 된다.
22일 기획재정부가 최근 발표한 세법 시행령 개정안에 따르면 오는 2022년부터 이 같은 내용의 가상자산 과세가 시작된다.
비트코인 거래를 통해 발생한 소득 중 기본공제 250만원을 적용하고 초과분에 대해 세율 20%로 과세하는 방식이다.
만약 한 해 동안 비트코인으로 1000만원을 벌었다면, 기본 공제 250만원을 뺀 750만원에 대해 양도차익 과세 20%를 해 세금 150만원을 납부해야 한다.
과세 대상 소득은 총 수입 금액(양도·대여 대가)에서 필요 경비(실제 취득가액 등)를 뺀 금액이다. 여기서 필요 경비를 계산할 때는 '선입선출법'을 적용한다. 먼저 매입한 가상 자산부터 순차적으로 양도한 것으로 여겨 필요 경비를 따지는 것이다.
특히 과세 시점(2022년 1월1일) 이전에 보유하고 있던 암화호폐 자산도 과세 대상이다. 정부는 의제 취득가액을 도입해 이전에 산 가상 자산의 가격을 올해 말 시가와 실제 취득가액 중 큰 것으로 정할 수 있도록 했다.
기재부 관계자는 "2021년 말 현재 시가를 적용해 과세가 많이 되지 않도록 보완한 것"이라고 말했다.
소득세 부과를 위해 가상 자산 사업자는 2022년 1월1일부터 분기·연도별 거래 내역 등 거래자별 거래 명세서를 제출해야 한다.
이와 함께 가상자산을 상속·증여할 때도 과세 대상이 된다.
한편 최근 비트코인 시세가 오르면서 투자자들 사이에서는 주식 과세와의 형평성 문제가 있다는 불만이 나온다. 2023년부터 과세가 시작되는 주식 양도소득세의 경우, 기본공제액이 5000만원이나 되기 때문이다.
청와대 국민청원 게시판에는 '비트코인은 250만원 이상 과세, 주식은 5000만원 이상 과세, 차별하지 마세요'라는 제목의 청원 글이 22일 현재 3만8400여명이 공감을 표했다.
청원인은 이 글에서 "비트코인 투자자는 주식 투자자에 비해 인원이 적어 목소리를 못 내니 세금을 왕창 걷어도 따라야 할 것이라는 (의도라는) 생각밖에 들지 않는다"고 꼬집었다.
20% tax on bitcoin income from next year
Starting next year, if you earn more than 2.5 million won with bitcoin, you will pay 20% of the transfer gain as tax.
According to the amendment to the tax law enforcement decree recently announced by the Ministry of Strategy and Finance on the 22nd, the taxation of virtual assets with such content will begin from 2022.
It is a method of applying a basic deduction of 2.5 million won among the income generated through bitcoin transactions and taxing the excess at a tax rate of 20%.
If you earned 10 million won with bitcoin during the year, you should pay a tax of 1.5 million won by paying 20% of the capital gains tax on the 7.5 million won minus the basic deduction of 2.5 million won.
Taxable income is the total amount of income (transfer/rental consideration) minus necessary expenses (actual acquisition price, etc.). When calculating the necessary expenses, the'first-in-first-out' method is applied. The virtual assets purchased first are considered to have been transferred sequentially, and the necessary expenses are evaluated.
In particular, cryptocurrency assets held before the time of taxation (January 1, 2022) are also subject to tax. The government introduced an agenda acquisition price so that the price of previously purchased virtual assets could be set as the greater of the market price or the actual acquisition price at the end of this year.
An official from the Ministry of Science and Technology said, "It was supplemented so that taxation was not increased by applying the market price as of the end of 2021."
In order to impose income tax, virtual asset business operators must submit transaction statements for each trader, including quarterly and yearly transactions from January 1, 2022.
In addition, the inheritance or donation of virtual assets is also subject to taxation.
Meanwhile, with the recent rise in the bitcoin market, there are complaints among investors that there is a problem of equity taxation and equity. This is because the basic deduction for stock capital gains tax, which begins to be taxed in 2023, is 50 million won.
On the Blue House National Petition bulletin board, a petition titled'Bitcoin taxed more than 2.5 million won, stocks taxed more than 50 million won, do not discriminate', as of the 22nd, expressed sympathy with 38,400,000 people.
Petitioner said in this article, "Bitcoin investors have fewer people than stock investors, so I can't speak out, so I only think (intention) that I will have to follow even if I raise taxes."
