● A Respectful Appeal to the Appellate Court Hearing the Case of Mayor Oh Se-hoon

I was taught that judges speak through their judgments and, through those judgments, give effect to justice. However intense political interests and public opinion may become, the courtroom must remain governed solely by law and evidence. I believe this is the very reason for judicial independence and the solemn responsibility the people have entrusted to judges. As someone who studied law at an American law school, I was repeatedly taught that one of the most fundamental principles of a criminal trial is proof “beyond a reasonable doubt.” The identity of the defendant, his political standing, and the prevailing direction of public opinion cannot determine guilt or innocence. Whether the prosecution has established the essential facts of the alleged crime through evidence, and whether that proof excludes reasonable doubt, must be both the starting point and the ultimate basis of the court’s decision.

Viewing the trial court’s judgment from the perspective of an American legal professional, I found myself troubled by questions I could not readily set aside. Were the essential links necessary to convict Mayor Oh sufficiently established? Were the grounds supporting the credibility of the witnesses and the materials casting doubt on their accounts evaluated in a balanced manner? Were gaps between separate facts bridged by assumptions rather than evidence? The political sensitivity of a case does not, by itself, justify calling the proceedings a “political trial.” Yet precisely because the case is politically sensitive, the grounds for a finding of guilt must be explained with particular clarity. I respectfully ask the appellate court not to take the existing conclusion as a given, but to examine anew the evidence and reasoning on which it rests.

Of the ten opinion polls included in the charges, the trial court found that five had been commissioned and paid for by a third party, while concluding that the commissioning or third-party payment of the remaining polls had not been proven. It sentenced Mayor Oh to a fine of KRW 10 million and ordered the forfeiture of KRW 21 million. The trial court itself did not assess all the polls in the same way. The appellate court should therefore examine what evidence distinguished the polls for which guilt was found from those for which it was not, whether that distinction was justified, and how Mayor Oh’s involvement in each poll and its payment was established.

The existence of several opinion polls does not, in itself, establish that they were all commissioned under the same circumstances or pursuant to the same agreement concerning payment. The court must determine whether communications concerning one poll also establish involvement in another, and whether knowledge formed at a particular point can be attributed to conduct occurring before or after that point. Considering the overall course of events is different from dispensing with proof of individual charges. Even within the broader context, there must be clear grounds supporting each act for which guilt is found.

What the court must decide in this case is neither the merits and shortcomings of Oh Se-hoon as a politician nor his political future. The question is whether the prosecution has proven the alleged violations of the Political Funds Act to the standard required by law. That is the question before the court. I respectfully ask you to examine, one by one, at whose direction the polls were conducted, how the decision for a third party to bear their costs was made, and how Mayor Oh participated in that process. There is a distinction requiring proof between a politician benefiting from an opinion poll and that politician participating in an unlawful arrangement to pay for it.

The fact that someone conducted a poll is not the same as proof that Mayor Oh commissioned it or participated in its commissioning. The fact that someone paid for a poll is likewise not the same as proof that Mayor Oh requested that payment or participated in an arrangement for a third party to bear the cost. His receipt of poll results may also be significant evidence. But what that evidence establishes can be understood only by examining when and how he received the results, together with his knowledge of the payment arrangement. The reasoning connecting these separate facts must be supported by evidence.

Of course, a direct request or instruction from Mayor Oh himself is not the only possible form of evidence. Communications through aides, the allocation of responsibilities, statements by those involved, and conduct before and after the events must also be considered. The charges in this case include allegations that third-party payments were arranged through former Deputy Mayor Kang Cheol-won, who was then an aide to Mayor Oh. Accordingly, the absence of a direct request by Mayor Oh to Mr. Myung Tae-kyun or Mr. Kim Han-jung does not resolve every issue. At the same time, an aide’s position alone does not make all of that aide’s actions attributable to the candidate. The court must examine what evidence establishes specific communications between Mayor Oh and his aide, as well as their knowledge of the alleged criminal conduct.

A criminal conviction may be based on circumstantial evidence considered as a whole, even without direct evidence. But the resulting inferences must accord with logic and ordinary experience. An inference that individuals must have shared an understanding because they were personally acquainted, or that receipt of results necessarily implies knowledge of the payment arrangement, requires supporting grounds at each step. Uncertainty at one stage must not become an unquestioned premise at the next. What matters is not simply whether direct evidence exists, but whether the evidence as a whole is sufficient to exclude reasonable doubt concerning the charges.

It is from this perspective that I ask the appellate court to examine the recordings of conversations between Mr. Kim Han-jung and Mr. Myung Tae-kyun submitted on appeal. Mr. Kim said, “They wanted it—no, it wasn’t even something they asked for; I did it on my own.” Mr. Myung also said, “It had nothing to do with Mayor Oh; it was between you and me, with you helping like that.” One used language describing his own independent actions, while the other made a statement that could be read as indicating that the matter proceeded independently of Mayor Oh. The court must determine precisely what these statements referred to.

Were these remarks merely explanations of personal acquaintance with Mayor Oh or of who introduced whom? Or did they describe how the polls were commissioned and paid for? Were they confined to a particular poll? Or did they describe an arrangement common to several polls? Did they mean that there had been no request from the candidate’s side? Or had there been a request, with Mr. Kim merely emphasizing his own role? Whatever interpretation is adopted, the reasons it accords with the full recordings and the other evidence must be explained.

I do not contend that these two statements alone conclusively establish Mayor Oh’s innocence. Treating isolated sentences from a recording as determinative of the entire case would itself be inconsistent with the principles of criminal adjudication. But if statements made at the time by central figures in the alleged events can reasonably be read as denying Mayor Oh’s involvement, their meaning must be examined specifically. That examination cannot end with the observation that another interpretation is possible. The court must explain why that interpretation is persuasive and what evidence supports it.

Moreover, these conversations took place in 2021, before the matter developed into a political and criminal dispute. A contemporaneous statement is not invariably truthful. People may conceal facts or make statements intended to reassure the person with whom they are speaking. But those possibilities, too, must be assessed against specific circumstances and materials. If statements made at the time differ from accounts given years later, the earlier statements cannot be rejected simply because the later accounts are more detailed.

The appellate court admitted these audio files as impeachment evidence for challenging the credibility of Mr. Myung’s statements. This does not mean that the recordings themselves conclusively establish innocence. They are nevertheless important because they require renewed scrutiny of the reliability of statements used to support a finding of guilt. Regardless of whether the recordings directly establish the facts of the alleged crime, they may undermine the evidentiary weight of testimony offered to prove those facts. Unresolved doubts about the credibility of that testimony may therefore affect the grounds for conviction.

The special prosecutor questioned whether the files were originals and raised the possibility of editing or selective submission. These issues must not be treated lightly. The authenticity and completeness of the files, and their relationship to the conversations as a whole, must be verified. Nevertheless, the fact that a concern has been raised must be distinguished from a finding that manipulation or editing that alters the meaning actually occurred. The same rigor is required both when interpreting the recordings and when questioning their reliability. They should neither be accepted uncritically because they favor the defendant nor rejected merely because they were submitted at a late stage.

In a written statement submitted ahead of the final appellate hearing, Mr. Myung offered a new explanation of his earlier remarks. He claimed that his statement during the telephone conversation of March 6, 2021, to the effect that “Oh Se-hoon doesn’t really know,” did not mean that Oh was unaware of the polls, but rather that he was not receiving reports on every detail of the strategy for agreeing on a single opposition candidate. Mr. Myung also explained that, because Oh had already been confirmed as the People Power Party’s candidate for mayor of Seoul, the conversation was not about polls conducted for the party primary.

At precisely this point, I wish to raise a question about what must be proven. Even if Mr. Myung’s explanation is accepted, does it establish Mayor Oh’s involvement in commissioning the polls and arranging payment for them? An explanation that “I did not mean he was unaware of the polls” is different from proof that “Mayor Oh commissioned those polls and participated in an arrangement for a third party to pay for them.” Even if the former is accepted, the latter must still be established through the other evidence considered together.

At least three questions must be distinguished in this case. Did Mayor Oh know that the polls existed? Did he participate in commissioning and conducting them? Did he know that a third party was paying for them, and did he participate in that process? These questions are related, but they are not identical. Even if knowledge of the polls themselves is established, that does not automatically prove the knowledge and involvement necessary for criminal liability concerning the polls and their payment.

The defense is not required to prove that “Mayor Oh knew absolutely nothing about the existence of the polls.” It is the prosecution that must prove the charged facts constituting the elements of the offense. An inadequate explanation by the defendant does not, by itself, make the prosecution’s proof adequate. There must also be grounds connecting a finding that the defense’s account is difficult to accept with a finding that the burden of proving guilt has been discharged. This is why the court must identify precisely which doubts Mr. Myung’s subsequent explanation resolves.

Nor does interpreting “Oh Se-hoon doesn’t really know” as a reference to the strategy for selecting a single opposition candidate resolve the meaning of the other remarks in the same conversation. What did Mr. Kim’s statement describing his independent actions refer to? What did Mr. Myung’s statement that could be read as denying Mayor Oh’s involvement refer to? Were these statements also confined entirely to that strategy? If so, why did such expressions arise in a conversation concerning polls and payment? I respectfully ask the court not to allow an explanation of one sentence to substitute for examination of the issues raised by the recording as a whole.

The explanation that the conversation took place after Oh’s nomination had been confirmed must likewise be compared with the actual content of the conversation. Confirmation of a candidate’s nomination does not prevent people from discussing polls conducted earlier or their costs. The date of a conversation and its subject matter are distinct. The full recording must be examined to establish what was being discussed, which polls conducted before or after the nomination were involved, and how the discussion of payment arose.

Can the statements made at the time be reconciled with the explanation now offered? If so, why? If they cannot readily be reconciled, which account is more consistent with the other materials? What independent evidence supports the present explanation? These questions are not intended to prejudge Mr. Myung’s statements as false. They are intended to test whether those statements can properly serve as a basis for a finding of guilt.

A court may accept some parts of a person’s account while rejecting others. But if it accepts the portions supporting guilt and rejects those conflicting with that conclusion, the reasons for drawing that distinction must be clear. They must be explained by reference to the circumstances in which each statement was made, its specificity and consistency, and its agreement with other evidence. Selecting statements to fit a conclusion cannot satisfy the requirement of rigorous proof.

I also ask the court to consider the results of the scrutiny undertaken in the courtroom. What matters is which doubts were resolved through cross-examination and comparison with other evidence, and which doubts remain. The submission of a written statement does not itself establish the truth of its contents. Conversely, differences in wording from an earlier account do not justify rejecting the statement in its entirety. Credibility cannot be determined solely by a person’s political position or interests in the case. It must be assessed through the substance of the account and the results of its examination.

What this case requires is neither excessive reliance on any single item of evidence nor the hasty rejection of material that is difficult to reconcile with a preferred conclusion. The recordings, written statements, communication records, and payment documents must be considered together. The court must examine which parts of the charges each item supports and which parts it calls into question. Its examination must go beyond connecting evidence that supports guilt; it must also address materials that are difficult to reconcile with those connections.

Reasonable doubt does not mean every conceivable doubt. A finding of guilt is not precluded by vague possibilities or unsupported questions. But if there are material differences between a central participant’s contemporaneous statements and later account, and those differences bear on the defendant’s involvement, they require specific examination. The court must determine whether other evidence resolves those doubts or whether they remain reasonable doubts that prevent a finding of guilt.

The fact that polls were conducted, that Mr. Kim paid for them, and that Mayor Oh received their results may all be significant. Yet the grounds connecting those facts to Mayor Oh’s participation in a crime must be examined to the end. The same applies to the communications and conduct of his aides. I ask the court to determine whether the evidence as a whole sufficiently establishes Mayor Oh’s intentions and knowledge, or whether it remains difficult to exclude the explanation that the individuals concerned acted independently.

Honorable members of the appellate court, I am not asking you to excuse Oh Se-hoon because he is a politician. Nor am I asking for leniency because he is the mayor of Seoul. Still less am I asking you to protect his political future. I ask only that you consider him as the defendant, Oh Se-hoon. Please distinguish suspicious circumstances from proven criminal facts. The court’s conviction must not be the starting point of its examination of the evidence; it must be the result reached after considering both favorable and unfavorable materials.

At the final appellate hearing held on October 2, the special prosecutor requested the same sentence as at trial: one year and six months’ imprisonment and forfeiture of KRW 33 million. The fact that the requested sentence remained unchanged does not establish either the sufficiency or the insufficiency of the proof. A sentencing request is the prosecution’s submission; determining guilt or innocence is the court’s responsibility. The court must now consider all the evidence and decide whether the charges have been proven beyond a reasonable doubt. Before considering the need for severe punishment, the criminal facts that would justify that punishment must first be rigorously established.

The consequences of this judgment are substantial. If the sentence imposed at trial becomes final, Mayor Oh will lose his office. But the trial court’s judgment is not yet final. Political responsibility may be debated, but the prosecution’s sentencing request must not be treated as a final judgment, nor should the outcome of the appeal be prejudged. The intensity of public suspicion cannot justify anticipating the judicial conclusion. Legal responsibility must be determined in the courtroom according to law and evidence.

It is also significant that this case may profoundly affect the office and political rights of a public official chosen by the electorate. That is not a reason to acquit him. Nor is it a reason to apply a higher standard of proof to an elected official than to an ordinary citizen. My appeal is that the rigorous principles applicable to every defendant should remain unwavering in politically significant cases as well. Election to public office does not confer immunity from criminal responsibility, and political importance cannot compensate for insufficient proof.

This principle cannot distinguish between progressives and conservatives. It must not change because today’s defendant is a conservative politician, nor because tomorrow’s defendant may be a progressive politician. If we demand rigorous proof for politicians we support while calling for the conviction of those we oppose on suspicion alone, the rule of law loses its foundation. The authority of the judiciary is preserved by applying the same standards to the same evidence and legal principles.

An important function of an appeal is to reconsider whether an earlier judgment was correct. If there are grounds for maintaining the trial court’s assessment of the evidence, those grounds must be examined. If new materials or revealed contradictions require reconsideration, those matters must be identified precisely. Whether the conclusion is upheld or changed, the central issues require a thorough explanation. If differences have been raised between the statements supporting guilt and contemporaneous materials, addressing those differences is also essential to the persuasiveness of the judgment.

If reasonable doubt remains concerning an essential fact necessary for conviction, I earnestly ask the court not to disregard it. Such doubt is not an inconvenient obstacle to be passed over on the way to a conviction. It is the final safeguard the law has established against convicting an innocent person. The state’s power to punish crime and the legal limits that protect citizens must both be respected. Strict observance of those limits does not weaken the authority of criminal justice. It provides the basis on which the public can accept that authority.

A judge’s courage does not lie only in resisting public opinion. I believe it also lies in correcting an earlier judgment if the evidence and law show it to be wrong, and in reaching the conclusion the law requires regardless of its political consequences. If the crime has been proven, the court should convict without fear of political repercussions. If it has not been proven, the court should acquit without fear of political repercussions. Judicial independence is preserved when either conclusion rests faithfully on law and evidence.

As an American legal professional, I was taught that what ultimately matters most in the courtroom is evidence and the rule of law. I believe the same is true in the courts of the Republic of Korea. The public can trust the judiciary when politics stops at the courtroom door and evidence and law govern its decisions. People may agree or disagree with a judgment. But everyone should be able to see that the court confronted the central questions and answered them on the evidence.

Honorable members of the appellate court, I make one final, earnest appeal. Please review the record once more. Examine both the materials favorable to the defendant and those unfavorable to him. Address the questions raised by the differences between the contemporaneous recordings and the subsequent statements. Through that examination, determine whether Mayor Oh’s involvement has been proven beyond a reasonable doubt. And if the prosecution’s proof ultimately falls short of that standard, I respectfully ask you to set aside political repercussions and public opinion on either side, and acquit him solely in accordance with law, evidence, and your judicial conscience.

Such a judgment would uphold the principle that no one in the Republic of Korea may be convicted without sufficient evidence. It would affirm that the same principles of criminal justice apply to progressives and conservatives, to the powerful and to ordinary citizens alike. And it would demonstrate that justice remains alive in the Republic of Korea.
