Adieu, Prosecution Service—Will You Be Reborn in 2030?

- Kim Se-hyung, Journalist

With President Lee Jae-myung’s approval ratings currently sliding, a growing number of voices on YouTube are speculating that the Supreme Court—under Chief Justice Cho Hee-de—will soon resume the remanded trial regarding election law violations. They argue that this could lead to Lee’s ouster from the presidency without the need for impeachment, paving the way for a new presidential election next year.

While it is unlikely that President Lee’s term will actually end prematurely as these YouTube pundits claim, if such a hypothetical scenario were to materialize, the abolition of the Prosecution Service (scheduled for October 2, 2026)—alongside the stripping of prosecutorial investigative powers and the revision of the "three judicial laws"—would stand out as virtually his only notable achievements during his brief 16-month tenure. Although the KOSPI index tripled and exports surged, these gains were largely driven by the semiconductor industry; conversely, the fact that individual investors lost a staggering 56 trillion won in leveraged ETFs means the stock market rally would likely be excluded from the list of positive accomplishments.

The abolition of the Prosecution Service and the revision of the three judicial laws represent a monumental shift that completely overhauled the nation's judicial system—a change occurring 78 years after the government's establishment in 1948. Whether these moves constitute genuine reform or a regression will be judged by history. Starting October 26, 2026—when the Prosecution Service is replaced by the Public Prosecution Office and the Major Crimes Investigation Office—voters will scrutinize the results. They will assess whether stripping prosecutors of investigative powers truly protects human rights or, conversely, leaves the vulnerable unprotected and renders daily life more insecure. Ultimately, they will deliver their verdict through the ballot box in the 2028 general election and the 2030 presidential election. Prior to the abolition of the prosecution's authority to conduct supplementary investigations, a Gallup poll showed that 61% of the public supported retaining the power, while only 23% favored total abolition—meaning opposition to abolition outweighed support by nearly three to one. Although Lee Jae-myung had previously expressed support for retaining the power on three occasions, he abandoned his convictions during the party leadership election in a bid to secure votes from the party's hardline faction. He prioritized the personal gain of party leadership over the interests of the nation and its people, and his approval rating plummeted thereafter.

Figures such as Rhyu Si-min, Kim Ou-joon, Choo Mi-ae, and Kim Yong-min incessantly clamor for "prosecution reform" despite the prosecution's powers having already been drastically curtailed; they are individuals trapped in their own dogmas, completely disregarding the public. The legislation effectively stripping the prosecution of its investigative powers—specifically regarding ordinary criminal cases—was passed in May 2022 under the Moon Jae-in administration; even then, Gallup polls indicated greater public opposition (47%) than support (36%).

Around the time the final debate over abolishing the prosecution's supplementary investigation authority was taking place this year, several incidents highlighted the necessity of that power. In one case, police attempted to "fabricate" the rape and murder of a high school girl by the son of a senior police officer, Jang Yun-gi, by classifying it as a simple homicide; the truth was only revealed through the prosecution's supplementary investigation, leading to a life sentence for the perpetrator. Similarly, a case involving the death of a missing woman—which a police officer in Jeju had attempted to close under false pretenses—would likely have been buried had it not been for the prosecution's supplementary investigation. The same was true for the victim of the "Busan Roundhouse Kick" assault case. Just when it seemed that supplementary investigations by the prosecution might be revived following three specific incidents, hardline factions within the Democratic Party—including figures like Cho Kuk who emerged from the activist movement—seemed driven by a deep-seated grudge; they ultimately ensured the era of prosecutorial investigation was buried for good on October 2, 2026. It is Lee Jae-myung’s own karma that he failed to prevent this.

The activist faction clashed head-on with the Yoon Suk-yeol-led prosecution—first over the suicide of Roh Moo-hyun and later during the investigation into then-Justice Minister Cho Kuk. Driven by a vindictive determination to "rein in" the prosecution—which they accused of becoming a political force—they succeeded in making South Korea the only advanced OECD nation to completely abolish an organization bearing the title of "prosecution."

Police investigative techniques lag behind those of the prosecution. The police are particularly vulnerable to political influence; furthermore, now that they hold exclusive investigative authority, even experienced senior officers avoid investigative roles, viewing the work as arduous and poorly compensated. The force appears to be teeming with inexperienced novices who lack a grasp of the realities of the job.

Originally, Minister Jeong Seong-ho had proposed placing a "Major Crimes Investigation Agency" under the Ministry of Justice, designating prosecutors as "investigative judicial officers" with seniority over general investigators—a plan intended to preserve the elite investigative expertise of prosecutors—but the Democratic Party rejected the proposal.

I would hate to imagine that hardline activist politicians abolished the prosecution's investigative powers simply because they recognized the police's investigative capabilities as weak and wanted to act with impunity, much like Kim Seung-won. Yet, the fact remains that the United States, Japan, the UK, Germany, France, and Italy all maintain prosecutorial organizations; while the UK is relatively passive regarding investigations, prosecutors in other advanced nations actively participate in them. South Korea’s investigative system is now a complex patchwork comprising the Major Crimes Investigation Agency (handling six categories of offenses: corruption, economic crimes, defense-related crimes, narcotics, insurrection/treason, and fraud), the Corruption Investigation Office for High-ranking Officials (CIO), the National Office of Investigation, and the general police force. While the CIO employs a number of prosecutors, and about 100 of the nation's 2,900 prosecutors have transferred to the Major Crimes Investigation Agency, they no longer use the title "prosecutor." The Prosecution Service is responsible for indictments based on police investigations, but its authority is limited to requesting supplementary investigations when it finds deficiencies in the police's work. If the police merely go through the motions—shielding one another—and simply dismiss the request by claiming, "This is the supplementary work we've done," that is the end of the matter. Former Justice Minister Jeong Sung-ho expressed concern that this cycle of endless requests for supplementary investigations would lead to a mountain of unresolved cases, ultimately spelling ruin for the Democratic Party.

The era of the Major Crimes Investigation Agency and the Prosecution Service has now begun, with the police taking exclusive charge of investigations. The Major Crimes Investigation Agency is shifting from the jurisdiction of the Ministry of Justice to that of the Ministry of the Interior and Safety. The public will be closely watching this new system, in which the police handle investigations and the prosecution's investigative role has been abolished. Concerns are already being raised that if the Major Crimes Investigation Agency—tasked with effectively investigating major crimes—instead focuses on pushing for the withdrawal of charges against President Lee Jae-myung, the outcome would be disastrous.

If the People Power Party becomes the majority party in the 2028 general election and subsequently wins the presidency in 2030, will there be a push to restore the Prosecution Service? When I sought the views of the People Power Party on this matter, they predicted that while a 100% return to the prosecution system that existed prior to September would be difficult, the system would at least revert to the average standards seen in countries like the United States, Japan, and Germany. In other words, a "rebirth" of the prosecution service is within the realm of possibility.
